The petitioner seeks bail in a case registered under Sections 364(A) of the Indian Penal Code.

Allegation is that on 10.06.2018 the petitioner took the informant's son, namely, Akshay Kumar with him. When his son did not return till night, a search was made but he was not traced out and his mobile was found switched of. On the next day the informant received a call and there was a demand of Rs.5 lacs as ransom and in case of failure to make payment he was threatened to kill his son.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.21421 of 2019(3) dt.08-05-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no substantive evidence to suggest the implication of the petitioner in the present case. The victim boy has already been recovered.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Nalanda in connection with Bind P.S. case No.58 of 2018.
