JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner appears to have been elected as Ward Councilor of Ward No. 18 of Nagar Panchayat Jogbani. She seeks anticipatory bail as she has been made accused in a case registered for the offences punishable under Sections 420, 177 of the Indian Penal Code read with Section 447 of the Municipal Act, 2007.

First Information Report has been instituted by the Incharge Tax Daroga of the said Nagar Panchayat with the allegation that the petitioner had given false statement at the time of filing her election papers that a child was born to her on 15.5.2005 though the said child was born on 4.4.2008.

Patna High Court Cr.Misc. No.48080 of 2014 (2) dt.23-04-2015 In view of the nature of dispute, let petitioner above named in the event of her arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Jogbani P.S. Case No. 115 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
