In this case, the petitioner is seeking anticipatory bail in connection with Alamnagar P.S. Case No.03 of 2017, registered for the offence punishable under Sections 376(D) of the Indian Penal Code.
Allegation has been made that while the informant was returning from his basa after feeding the cattle, in the midway the brother of the petitioner and two unknown persons have intercepted and at the behest of the brother of the petitioner said two unknown persons have perpetrated rape on her. In the FI.R. as well as other parts of the case diary, allegation has been made against the petitioner that he has threatened the informant to repeat the same offence against her,
Patna High Court Cr.Misc. No.24005 of 2017 (3) dt.25-08-2017 2/2 but there is no offence.
Looking to the aforesaid facts, let the petitionerShalendra Sharma, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Udakishunganj, District- Madhepura, in connection with Alamnagar P.S. Case No.03 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
