====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is in custody in connection with Kuchaikote P.S. Case No. 55 of 2020 for the offence under sections 30(a), 41(i) of Bihar Prohibition and Excise Act. 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 2655 liters of liquor was seized.

The petitioner is in custody since 17.2.2020. Considering the fact that petitioner has no criminal antecedent and he is in custody since 17.2.2020, the Court is inclined to grant bail to the petitioner subject to the condition that the petitioner shall deposit Rs. 1,00,000/- (One lakh) cash in

Patna High Court CR. MISC. No.24869 of 2020(2) dt.28-09-2020 2/2 the court below and on deposit of Rs. 1,00,000/- the court below shall release the petitioner named above on furnishing bail bond of Rs. 1,00,000/- (One lakh) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge-2 cum Special Judge,Excise, Gopalganj, in connection with Kuchaikote P.S. Case No. 55 of 2020.

Deposit of Rs. 1,00,000/- shall abide by final outcome of the pending criminal case.
