Petitioner seeks bail in Dehri Town P.S. Case No.1124 of 2018 instituted for the offence under Section(s) 400, 401, 411 & 414 Indian Penal Code and Sections 25(1-b), 26(A), 35 of the Arms Act.

Counsel for the petitioner submits that from the written report it will appear that name of this petitioner has been disclosed by co-accused, Faisal Raza, alleging that he has sold the stolen motorcycle to Jaswant Singh and this petitioner. The police raided the house of this petitioner and one mobile phone has been recovered. Police also recorded confession of this petitioner.

Patna High Court CR. MISC. No.21438 of 2019(2) dt.05-04-2019 2/2 In this manner, there is no recovery of stolen motorcycle from possession of the petitioner. Petitioner is in custody since 14.12.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Dehri Town P.S. Case No.1124 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
