JUSTICE SANJAY PRIYA ORAL ORDER 2/ 28-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Shivsagar P.S. Case No.272 of 2016 instituted for the offence under Section(s) 341, 323, 325, 307, 504, 506/34 Indian Penal Code. It is alleged that this petitioner assaulted the Informant with Lohbanda in the stomach.

During the course of argument, counsel for the petitioner has pointed out that the doctor had examined the injured on 20.10.2016 but prepared the Injury Report on 22.10.2016 stating the injuries to be grievous in nature. Injury Report has been annexed as Annexure-3, from the perusal of which it appears that none of the injury was found on the vital part. The injuries were

Patna High Court Cr.Misc. No.348 of 2017 (2) dt.28-01-2017 2/2 on arms and knee etc. The doctor has merely stated that there was pain in abdomen. Besides this, there was no injury of Lohbanda in the stomach of the injured. The petitioner is in custody since 15.11.2016.

In view of such, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Shivsagar P.S. Case No.272 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
