JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 147,148,149,323,324,307, 504 & 379 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner, referring to the First Information Report, submits that the only allegation against the petitioner is that he gave a farsa blow on the head of Rama Yadav. He submits that on medical examination, the injury of fracture of ring figure bone has been found by the doctor which has been found to be grievous. The injuries on the scalp of the said Rama Yadav have not been found to be grievous.

Patna High Court Cr.Misc. No.48128 of 2014 (3) dt.23-04-2015 He submits that in similar facts and circumstances of the case other accused persons, namely, Nand Kishore Yadav who is said to have been given Farsa blow on the head of the informant has been granted anticipatory bail vide order dated 13.1.2015 passed in Cr. Misc. No. 29670 of 2014 by this Court. In view of the submission as above, let petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in Bairiya P.S. Case No. 299 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
