JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks anticipatory bail in a case registered for the offences punishable under Section 504 of the Indian Penal Code and Section 3(1) (x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
Learned counsel for the petitioner submits that even on the basis of prosecution case no offence under Section 3(1) (x) of the SC & ST Act is made out inasmuch as, occurrence is not alleged to have taken place in public view.
In view of the nature of allegation and submission made above, let petitioner above named in the event of his
Patna High Court Cr.Misc. No.48130 of 2014 (2) dt.23-04-2015 arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sri P.K. Shrivastava, Judicial Magistrate, Ist Class, Sheikhpura in Barbigha P.S. Case No. 324 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
