The petitioner apprehends his arrest in Jagdishpur P.S. Case No. 144/2016, registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. A vehicle bearing registration no. BR 10GA 1839, loaded with illegal sand, was intercepted by the informant. Saroj Yadav was apprehended along with the tractor alleging that Saroj Yadav was driving the tractor. Saroj Yadav was released on bail as Investigating Officer disclosed that the petitioner Sunil Rai is the driver of the tractor.

It is submitted by the learned counsel for the petitioner that Sunil Rai is not driver of the tractor. He has no manner of concern with the said tractor.

No.24011 of 2017 (2) dt.14-07-2017 2/2 Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 144/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
