The petitioner seeks bail in Rajapakar P.S. Case No. 105 of 2018, instituted for the offences under Sections 376 of the IPC and Sections 4,6 of the POCSO Act.
It is alleged in the written report that while minor daughter of the informant aged nine years was returning after purchasing note book from the shop of one Sudhir Sah, this petitioner stopped her and took her in his lap to his house and committed illegal act with her. Learned Sessions Judge has mentioned in the impugned order that the victim was medically examined. After examination of the victim, doctor has found recent sexual activity.
In such circumstances, this court is not inclined to
Patna High Court Cr.Misc. No.76326 of 2018(2) dt.20-12-2018 2/2 grant bail to petitioner. Hence, the prayer for bail is rejected at this stage.
