2. The petitioner is apprehending arrest in connection with Ahiyapur P.S. Case No. 834 of 2018, Gr. No. 5086 of 2018 registered on 05.08.2018 for the offenses punishable under Section 365 of the Indian Penal Code.

3. As per the prosecution, the present F.I.R. has been lodged against the holder of a mobile number, alleging that her daughter has been kidnapped with the intent to commit a wrongful act or to cause her death.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is contended that the petitioner is not named in the F.I.R., and his name has surfaced in the investigation solely on the basis of

Patna High Court CR. MISC. No.22938 of 2025(2) dt.30-04-2025 2/2 suspicion and under a mistaken impression. The antecedents of the petitioner are clean.

5. Learned APP for the State vehemently opposes the prayer for bail and submits that at the time of consideration of the matter before the Sessions Court, the statement of the victim recorded under Section 164 Cr.P.C. was available, in which she specifically named the petitioner as one of her kidnappers and alleged that she was kept in his confinement for a period of 12 days.

6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Ahiyapur P.S. Case No. 834 of 2018, Gr. No. 5086 of 2018, pending before the learned CJM, Muzaffarpur, is hereby rejected.
