JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek anticipatory bail in a case registered for the offences punishable under Sections 341,323,307,379/34 of the Indian Penal Code.

Referring to the First Information Report, learned counsel for the petitioners submits that there is specific allegation against one Satyendra Singh of having assaulted the informant by an iron rod on his head. He submits that there is vague allegation of assault by these petitioners with lathi. He further submits that only one injury has been found on the person of the informant and therefore, so far these petitioners are concerned, no offence under

Patna High Court Cr.Misc. No.48141 of 2014 (2) dt.23-04-2015 Section 307 of the Indian Penal Code is made out against them. I find substance in the submission made on behalf of the petitioners. In view of the submission as above, let petitioners above named in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Brajesh Mani Tripathi, learned Judicial Magistrate, Ist Class, Jehanabad in Kaler P.S. Case No. 52 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
