NILU AGRAWAL ORAL ORDER 14-12-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 24.09.2016 in connection with Bihta P.S. case no. 696 of 2016 for offences alleged under Sections 341, 504, 506, 324, 302 of the Indian Penal Code.

The prosecution case as per the written report of the informant in brief is that the petitioner along with other have committed murder of Hira Prasad Choudhary.

It has been submitted by the learned counsel for the petitioner that no overt act has been committed by the petitioner. The allegation is upon her husband Ajay Chaudhary @ Panch and the only allegation against her is of abusing the

Patna High Court Cr.Misc. No.51926 of 2016 (2) dt.14-12-2016 informant's side. It has further been submitted that the petitioner has no criminal history.

However, learned A.P.P. for the State has stated that the petitioner is named in the F.I.R. hence, opposes the prayer for bail.

Be that as it may, considering the facts and circumstances and submissions of the parties, let the abovenamed petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. C.J.M. - II Danapur, Patna in connection with Bihta P.S. case no. 696 of 2016.
