JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 This application has been filed for quashing the order dated 05.09.2018 passed by learned A.C.J.M., Patna in Complaint Case No. 1098© of 2013 by which the petition of discharge under Section 245 of the Cr.P.C. has been rejected and petitioner has been directed to appear for framing of charge under Sections 406/34 of the Indian Penal Code. Learned counsel for the petitioner has produced a cheque of Rs. 65,000/- in the name of the opposite party no.2. On instruction from opposite party no.2, the learned counsel for the opposite party no.2 has agreed to accept the same and settle the dispute with the petitioner. In view of the above, this application is allowed.
