Petitioner apprehends his arrest in connection with Kumarkhand P.S. Case No. 173 of 2013 registered for the offences punishable under Sections 420, 468, 471 of the Indian Penal Code.
Allegedly, the petitioner being the Incharge Head Master of the school in question got admitted two students on the basis of forged and fabricated transfer certificates. Submission is that the petitioner is not an expert and on the basis of transfer certificate admission was allowed and 69 students have been admitted and except the two all have been found genuine. Patna High Court Cr.Misc. No.48841 of 2014 (2) dt.23-04-2015 bail to one Siyaram Yadav vide order dated 26.03.2015 passed in Cr. Misc. No. 11880 of 2015 and as such the petitioner deserves sympathetic consideration to which the learned APP opposes. Considering the aforesaid facts and circumstances as well as submissions of the parties, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 173 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
