JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Shakurabad P.S. Case No. 136 of 2014, registered under Sections 384, 385, 435, 341, 147 and 148 of the Indian Penal Code and Section 17 of the C.L.A. Act.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, the Investigating Officer has detailed in paragraph 41 of the case diary that he came to know that this petitioner is also the members of M.C.C. group, thereafter, the Dy.S.P. also detailed in his supervision note about the petitioner, except that there is nothing against the petitioner showing his involvement in the present case. Further submission is that petitioner has been made accused in
Patna High Court Cr.Misc. No.19126 of 2017 (3) dt.25-07-2017 Shakurabad P.S. Case No. 137 of 2014 due to that reason he has been implicated in the present case without any cogent material. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Jehanabad, in connection with Shakurabad P.S. Case No. 136 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
