ANJANA MISHRA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Roh P.S. Case No. 39/14 registered for the offences punishable under Sections 323, 341,307, 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the present case has been lodged in relation to retaliation of a Complaint Case No. 887 of 2014 filed by the wife of the petitioner No. 4. Learned counsel for the petitioner further submits that even if the contents of the First Information Report are considered, the injuries as stated in the said First Information Report have been falsified. Injury report of Md. Babar has been annexed herewith as Anenxure-2.
Patna High Court Cr.Misc. No.48985 of 2014 (2) dt.23-04-2015 Considering the submissions and above and also the nature of allegation, let the petitioners above named, in the event of their arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Nawada in connection with Roh P.S. Case No. 39/14, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
