====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Piprahi P.S. Case No. 132 of 2018, instituted for the offence under Sections 272, 273 of the Indian Penal Code, Sections 30(a), 38, 41 and 47 of Bihar Prohibition and Excise Act, 2016.

In the written report it is alleged that informant got information that Tarachand Sah, Fulbabu Sah, Dhiraj Singh and others were carrying huge quantity of liquor in a Maruti van and moving towards Piprahi from Belwa. The informant along with other police personnel proceeded towards Piprahi and when he reached Dostiya chowk, he learnt that vehicle has gone towards Masaudha from Piprahi Chowk. Thereafter, the informant proceeded towards Mesaudha and when he reached

No.77555 of 2018(2) dt.15-01-2019 2/2 near the house of Tarachand Sah, he found one Maruti Omni van parked in front of the house of Tarachand Sah and some people were unloading wine from the vehicle. On seeing the police party, they tried to run away leaving the cartons in the vehicle. Police chased them and caught three persons including petitioner.

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. He has no concern with the aforesaid liquor. He has clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise, Sheohar, or his successor, in connection with Piprahi P.S. Case No. 132 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
