JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 384, 386 and 302/34 of the Indian Penal Code and under Sections 2(V) and 3(X) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act. From the First Information Report, it appears that there is allegation against the sons of the petitioner of having assaulted the deceased.
Learned counsel appearing on behalf of the petitioner appears to be right in his submission that there is no allegation of assault against this petitioner nor any act, on his part, can be said to constitute offence under Sections
Patna High Court Cr.Misc. No.48226 of 2014 (2) dt.23-04-2015 2/2 2(V) and 3(X) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act.
It has been stated in paragraph no. 3 of the application that the petitioner is 72 years old having no criminal antecedent In view of the submission as above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, Judicial Magistrate, Patna city, District-Patna, in connection with Didarganj P.S. Case No. 184 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
