The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the accused persons tried to stop the Orchestra programme at the behest of the uncle of the informant Binit Jha. It is specifically alleged that co-accused Rahul Jha caused gun shot injury to the informant's waist. The brother of the informant Ram Balram Jha also received injuries. It is submitted by learned counsel for the petitioner that the petitioner is Navy Personnel. The accusation
Patna High Court Cr.Misc. No.48061 of 2015 (2) dt.04-11-2015 2/2 is omnibus and general against the petitioner. The specific accusation is only against Rahul Jha. The injury of the informant has been found to be simple in nature.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 603 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
