JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 16-05-2024 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 435, 504, 506, 307, 447, 427, 354 of the Indian Penal Code and section 27 of the Arms Act.

As per allegation in the FIR, named accused persons started to assault the informant and his son with the weapon in their hands and petitioner poured petrol over the head of Lalit Kumar Singh and petitioner Ramsakhi Devi set fire by matchstick due to which he sustained burn injuries. Accused Rakesh consigned a four wheeler car and two motorcycle to flame. Informant's daughter-in-law came there to rescue the informant,

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. There is case and counter case. Members of both sides have received injury. In the background of the alleged occurrence, there is long land land dispute. It is evident from the order passed in Cr. Misc. No. 66260 of 2022, injured Lalit Kumar has received 33-35 % burn injury and nature of injury is simple as opined by doctor. Petitioner has no criminal antecedent and he is languishing in judicial custody since 04.12.2023. Similarly situated several coaccused persons have been granted bail by this Court and coordinate Bench of this Court. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the period of custody and petitioner being a lady, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
