JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 504, 384, 385 and 379/34 of the Indian Penal Code and 3(i) (x) of Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel appearing on behalf of the petitioner, referring to the allegation as contained in the First Information Report, has submitted that no offence under provisions of Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act, is made against out in the facts and circumstances of the case as the occurrence is not said to have taken place in a public view. In view of the nature of the allegation and the submission as above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai SC/ST P.S. Case No. 43 of 2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
