The petitioner apprehends his arrest in connection with Giriyak P.S. Case No. 121 of 2017, registered under Sections 419, 420, 468, 471 and 486 of the Indian Penal Code, Sections 103 and 104 of the Indian Trade Mark Act and Sections 63 and 65 of the Copy Right Act.
The accusation is that informant, Kumar Daya Shankar, employee of Do Pont India Private Limited, came to know that at village Mangarbigha, P.S.- Giriyak, District Nalanda, in the house of petitioner, duplicate materials are being prepared in the name of Do Pont India Private Limited. Thereafter, he informed to the police on 12.04.2017 and reached at the village
Patna High Court Cr.Misc. No.24188 of 2017 (3) dt.19-08-2017 Mangarbigha along with police officials, where a person who present there, disclosed that Sujit Kumar (petitioner) used to reside in the house of Madan Lal Kumar, in which, duplicate company's packet sticker and other materials of Do Pont Inida Pvt. Ltd. and some empty container were recovered.
Learned counsel for the petitioner submits that, in fact, petitioner used to reside at the rented house of Madan Lal Kumar for doing the job of labourer and at the time of search, petitioner was not present there but he has falsely been implicated in this case mere on suspicion.
Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda, Bihar Sharif, in connection with Giriyak P.S. Case No. 121 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
