JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners, thirteen in numbers, seek anticipatory bail as they are accused in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 379 and 504 of the Indian Penal Code.

From the prosecution story, it appears that the petitioners were part of procession which was coming for

Patna High Court Cr.Misc. No.48251 of 2014 (2) dt.23-04-2015 2/2 immersion of idol Saraswati. It seems that some obstruction was caused leading scuffle between the two groups, wherein, both the sides appears to have sustained injuries. Accordingly, the present First Information Report came to be instituted, naming these petitioners as accused. Learned counsel for the petitioners has submitted that none of the injuries have been found to be grievous in nature. He has further submitted that there is case and counter case for the same occurrence.

In view of the submission as above, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, Bihar, in connection with Narari Kala Khurd P.S. Case No. 06 of 2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
