Heard learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks bail in Gayghat Police Station (for brevity, PS) Case No 180 of 2019 instituted for the offence punishable under Section 397 of Indian Penal Code and Sections 27 of Arms Act.
Patna High Court CR. MISC. No.26306 of 2020(2) dt.13-10-2020 2/3 The prosecution case is that while staff of Finance Company was returning after collecting cash, three unknown persons have looted him. The allegation is also of inflicting grievous injury on the stomach.
Petitioner's counsel submits that since the petitioner bears criminal antecedents coupled with the fact that he is the resident of the same village, where the occurrence has taken place, he has been implicated in this case. No incriminating aricle has been recovered from his possession nor is there any basis to his implication in this case. It is further submitted that he is in custody since 17.10.2019.
The learned APP for the State has opposed the prayer for bail.
Considering the rival submissions, prayer for bail is allowed. Let the petitioner, above named, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate X, Muzaffarpur in Gayghat PS Case No 180 of 2019 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. (ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
Learned counsel for the petitioner is expected to honour his undertaking given in the instant proceedings today for depositing requisite Court fee and removing the defect (s), as pointed out, when called upon to do so.
