JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Supaul Case No. 1007 of 2022, registered for the offence punishable under Sections 379, 411, 414, 468, 471, 420/34 of the Indian Penal Code.

Learned counsel for the petitioners submit that the petitioners are innocent and falsely been implicated in this case on the basis of confessional statement of co-accused Santosh Kumar Singh. Petitioners have no criminal antecedent. No arms was recovered from the possession of the petitioners. Petitioners are in custody since 01.11.2022.

Patna High Court CR. MISC. No.23454 of 2023(2) dt.22-05-2023 2/2 Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Supaul, in connection with Supaul P.S. Case No. 1007/2022.

This is also subject to the conditions that (I) the petitioner no. 1 shall mark his presence in Birpur Police Station, District- Supaul on first Sunday of every month and petitioner petitioner no. 2 shall mark his presence in the Fulkaha Police Station, District- Araria on first Sunday of every month, failing which, their bail bonds shall be cancelled by the court below.
