Petitioner apprehends his arrest in a case registered for the offence punishable under Section 323, 498(A) and some other ancillary Sections of the Indian Penal Code. Allegation against this petition is of committing torture and harassment upon the informant for non fulfillment of demand of dowry.

Petitioner is husband of the O.P. No.2 Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.23832 of 2022(3) dt.15-11-2022 2/2 case. It is further submitted that petitioner is ready to keep O.P. No.2 with full honour and dignity. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Bhagalpur in connection with Sanokhar PS case No. 139/ 2019, subject to conditions laid down u/s 438(2) of the Cr. P. C.
