Petitioner is in custody in connection with Mansi P.S. Case No. 11 of 2020 for the offence under sections 25(1-b)a , 26, 35 of the Arms Act.
Learned counsel for the petitioner submits that in this case from the bag of the petitioner three automatic pistols and six live cartridges were recovered and on query, the petitioner could not submit any documents as mentioned in para-14 of the present application. He further submits that all the documents as required by the would be submitted by the petitioner on restoration of normalcy.
The petitioner is in custody since 14.1.2020. Considering the fact that petitioner is in custody since
Patna High Court CR. MISC. No.21119 of 2020(2) dt.29-06-2020 2/2 14.1.2020., the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Khagaria, in connection with Mansi P.S. Case No. 11 of 2020 subject to the codition that both the bailors should be family members with further condition that on release the petitioner shall render his service as volunteer in dedicated Covid-19 hospital for a period of three months. He is required to report to the district Nodal Officer who shall utilize the service of the petitioner appropriately. He is also required to submit all the documents within a period of one month from the date of release, failing which, the court below shall be at liberty to cancel the bail bonds of the petitioner.
