The petitioner being the husband of the sister of the informant is languishing in custody since 22.07.2015 in a case registered for the offences punishable under Sections 498A, 304B and 201/34 of the Indian Penal Code.

Basic accusation is of killing the sister of the informant within one year of the marriage for non-fulfillment of the dowry demand.

A report was called for from learned trial court with regard to present stage of the trial. The report of the learned Additional Sessions Judge-IV, West Champaran, Bettiah dated 29.09.2016 reflects that the charges have been framed and out of five witnesses, four have been examined and the trial will be

It is submitted by learned counsel for the petitioner that all the witnesses have already been examined. Considering the present stage of trial, this Court is not inclined to grant bail to the petitioner in connection with Sessions Trial No. 23 of 2016 arising out of Majhaulia P.S. Case No. 157 of 2015 pending in the court of learned Additional Sessions Judge-VIth, West Champaran at Bettiah. It is expected from the learned trial court to conclude the trial expeditiously if it has not been concluded as yet. Accordingly, the application is disposed of.
