The petitioner seeks bail in a case instituted under Sections 363, 366(A) and 120(B) of the Indian Penal Code. The prosecution story in brief, is that the F.I.R. named accused persons came on three motorcycles and kidnapped the minor daughter of the informant and when the villagers came there, they fled away, leaving the motorcycles. It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.10.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. At best, it is a case of attempting for abduction. The other co-accused has been granted

Patna High Court Cr.Misc. No.53087 of 2016 (2) dt.16-12-2016 2/2 bail vide Cr. Misc. No. 52122 of 2016.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani, in connection with Bhairab Asthan P.S. Case No. 91 of 2016.
