Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Lakhisarai PS case no. 20 of 2025 dated 17.01.2025, disclosing offences punishable under Section 318(4)/ 3(5) of B.N.S. Act and Section 63 of Copy Right Act, 1957.

The prosecution story, as per the First Information Report, is that the informant is authorized representative of Ashirvad Pipe Private Limited. He got the information that in the district of Lakhisarai, some unscrupulous persons were selling fake pipes and water tanks

Patna High Court CR. MISC. No.21877 of 2025(2) dt.30-04-2025 2/3 by using the logo and brand name of Ashirvad Pipe Private Limited. Upon search, it was found that the petitioner is the proprietor of Bajrangwali Traders and was selling fake water tanks, pipes etc. One Niraj Kumar, who is the proprietor of Shri Laxmi Enterprises, was also found selling fake water tanks and pipes etc. It is alleged that the informant informed the police and accordingly, seizure list was prepared showing recovery of three water tanks of 500 liters, 100 pieces of fake CPVC of 1 inch each and 60 pieces of fake CPVC of 3/4 inch each having fake logo of Ashirvad company from the shop of the petitioner.

Learned Counsel for the petitioner submits that petitioner is the bonafide purchaser of the pipes and water tanks and he was not aware about the fact that pipe supplied to the petitioner was fake. Learned counsel further submits that the pipes seized from the premises of the petitioner were not verified/ examined in the laboratory.

Regard being had to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that fake pipes as well as water tanks having the fake logo of Ashirvad Company Private Limited was recovered from the shop, of which the petitioner is the
