The petitioners apprehend their arrest in connection with Town (Muzaffarpu) P.S. Case No. 726 of 2014 registered under Sections 147, 148, 149, 323, 188 and 353 of the Indian Penal Code.
The accusation is that petitioners along with several others made obstruction in the functioning of the officials, who had gone at the place of occurrence for removal of encroachment. Learned counsel appearing on behalf of the petitioners submits that the brother of the petitioners Md. Sohail Sidiqque has filed a criminal case vide Complaint Case No. 2561 of 2013 against the Sub-Inspector of Town P.S. Muzaffarpur in
Patna High Court Cr.Misc. No.47551 of 2014 (2) dt.23-04-2015 2/2 the Court of Judicial Magistrate and on the instruction of SubInspector, informant has implicated the petitioners in this case. It is also submitted that co-accused Shivnath Pd. Keshri, Rakesh Prasad, Pramod Kumar Keshri and Subodh Kumar Keshri have already been allowed anticipatory bail by a Bench of this Court vide Cr. Misc. No. 5297 of 2015 on 09.02.2015. Having considered the facts and circumstances of the case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Muzaffarpur in connection with Town (Muzaffarpur) P.S. Case No. 726 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
