JUSTICE RAKESH KUMAR ORAL ORDER 04-10-2016 Heard Sri Ajay Thakur, learned counsel, who was assisted by Smt. Babita Kumari, learned counsel for the petitioner and Mr. S.M.Rahman, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 22.07.2016 in Sahebpur Kamal P.S. Case No.115/2016 registered for the offence under Section 47(a) of the Bihar Excise (Amendment) Act, 2016 has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on false accusation of recovery of huge quantity of Indian Make Foreign liquor, the petitioner has been made accused in the present case. He submits that save and except the present case, there is no other case against the petitioner. This fact has been stated in paragraph-3 of the petition.

Patna High Court Cr.Misc. No.40630 of 2016 (2) dt.04-10-2016 2/2 Keeping in view the nature of accusation, clean antecedent of the petitioner and period of custody, let the petitioner, namely, Santosh Kumar be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-V, Begusarai in connection with Sahebpur Kamal P.S. Case No.115 of 2016.
