The petitioner seeks bail in Dalsingh Sarai P. S. Case No. 393 of 2017 instituted for the offence under Section(s) 323, 341, 302, 354/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for petitioner submits that petitioner is in custody since 18.12.2017.

In the written report, there is specific allegation that petitioner along with co-accused Shubhendu Kumar Choudhary fired from pistol causing injury in the abdomen and hand of father of the informant on account of which he died on the spot. Postmortem report also corroborates the allegation. The doctor has found two firearm injuries on the person of the

As such, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected. Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of one year from the date of receipt of copy of this order.

Petitioner may renew his prayer for bail in the event trial is not concluded within the aforesaid period. (Sanjay Priya, J) shyambihari/- U T
