The petitioner seeks bail in connection with Special Case No. 5202/2021 arising out of Chowk P.S. Case No. 302/2021 registered for the offence under Sections 30(a)/37(b) ©/32(1)/32(3)/41(1)/ 41(2) of Bihar Prohibition & Excise Act 2018 and Section 47 of Bihar Prohibition and Excise Act 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 28.02.2023 and it is alleged that there is recovery of 91.460 liters of country made liquor. Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody and the recovery of liquor, this application for regular bail is allowed.

No.23958 of 2023(2) dt.15-05-2023 2/2 Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna City in connection with Special Case No. 5202/2021 arising out of Chowk P.S. Case No. 302/2021.
The petitioner will visit Chowk, Patna Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
