The Petitioner seeks bail in Muffasil P.S.
Case No. 91 of 2016 instituted for the offence under Section(s) 25(1-A)/25(1-B)a/26(1)(2)(3)/35 of the Arms Act. It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent. The petitioner is in custody since 05.05.2016.
As per written report, the police received a massage that arms and ammunitions were kept hidden by coaccused Kishore Yadav in the house of this petitioner. The police, thereafter raided the house of this petitioner and recovered one semi automatic riffle, two country made pistols, twenty live cartridges and eight chargers from the house of the petitioner and
Patna High Court Cr.Misc. No.43821 of 2016 (7) dt.02-05-2017 2/2 arrested the petitioner.
It has further been submitted on behalf of the petitioner that petitioner is 70 years old and he is in custody for about one year. The charge has not even been framed in this case by the lower court.
From the written report itself, it appears that police got information that one Kishore Yadav had kept the arms and ammunitions hidden in the house of this petitioner. It has also been submitted on behalf of the petitioner that co-accused Kishore Yadav is already on bail granted by the lower court itself.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 91 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
