The petitioner seeks bail in Sonepur P.S. case No. 437 of 2015 under Section 379 of the Indian Penal Code. Later on Section 411 of the IPC was added.

The petitioner is not named in the FIR but it appears that stolen motor cycle was recovered from the possession of the petitioner.

The learned counsel for the petitioner submits that Lalu Sahni came on the stolen motor cycle and petitioner did not know about the fact that the motor cycle was stolen one that is why the motor cycle was recovered from the possession of the petitioner. The petitioner is in jail since 27.06.2016. The petitioner has already remained in jail for more than five months.

No.39505 of 2016 (3) dt.28-11-2016 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Saran at Chapra in Sonepur P.S. Case No. 437 of 2015.
