JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 399, 402, 413 and 414 of the Indian Penal Code and 25(1-B)a, 26 and 35 .

Allegation against petitioner is that he has been apprehended by police and on search arms were recovered from his possession.

It has been submitted on behalf of petitioner that he is in custody since 25.8.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that one loaded country made pistol along with two live cartridges is said to have been recovered. No compliance of Section 100 of the Code of Criminal Procedure is made. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.51991 of 2016 (2) dt.06-12-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Chief Judicial Magistrate, East Champaran at Motihari, in connection with Govindganj P.S. Case no. 222 of 2016.
