JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 Petitioner prays for bail in connection with Danapur P.S.Case No. 252 of 2018, corresponding to Special (Excise) Case No. 4093 of 2018, registered for the offences punishable under Sections 456, 354B, 323, 341 of the Indian Penal Code and Section 30(C) of Bihar Prohibition and Excise Act. Allegation against the petitioner, who happens to be nephew of the informant, is that he entered inside the house of the informant, torn off her clothes and tried to outrage her modesty.
Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and he is own nephew of the informant and further compromise has been arrived at between the parties and he is in custody for seven and

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna, in connection with Danapur P.S.Case No. 252 of 2018, corresponding to Special (Excise) Case No. 4093 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
