JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-02-2018 The petitioner has challenged the order dated 21.02.2015, passed by the learned Judicial Magistrate-Ist Class, Siwan in Raghunathpur P.S. Case No. 225 of 2014/G.R. Case No. 6092 of 2014, whereby cognizance under Sections 341, 323, 325, 307 and 34 of the Indian Penal Code has been taken against three accused persons, namely, Rajendra Sharma, Sanjay Sharma and Arun Sharma, whereas proceedings against Manju Kumari and Ranju

Patna High Court CR. REV. No.877 of 2015 (2) dt.19-02-2018 2/2 Kumari (opposite party Nos. 2 and 3 respectively) have been dropped as they were not sent up for facing trial by the police.

It appears from the impugned order that the court below examined the case diary and all the materials available before it to come to the conclusion that there is no material against opposite party Nos. 2 and 3. It may be noted that the petitioner is related to opposite party Nos. 2 and 3, who are unmarried daughters of her agnate, namely, Rajendra Sharma against whom cognizance has been taken and the case has been committed to the Court of Sessions for trial.

I do not any folly with the order impugned. The present petition is, therefore, dismissed.
