The petitioner being the Headmaster of the school is apprehending his arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code. It is alleged that the petitioner was provided Rs. Five lakhs for construction of the school building but he has not completed the construction work and misappropriated the money.

It is submitted by learned counsel for the petitioner that the petitioner made the construction work, though, it was not completed, but subsequently the petitioner deposited

Patna High Court Cr.Misc. No.46679 of 2014 (02) dt.23-04-2015 2/2 Rs.2,79,374/- in the bank account of the school. The application addressed to the District Programme Officer is suggesting the deposit made by the petitioner which has been brought on record as Annexure-3. It is further submitted that the petitioner has already retired.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Pipra P.S. Case No. 101 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
