The petitioner is apprehending his arrest in connection with Bagaha Mahila P.S. Case No. 12 of 2014, registered under Sections 498A and 233/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is ready to keep the victim.
Having regard to the facts and circumstances of the case, the above named petitioner in the event of his arrest/surrender within a period of four weeks from the date of receipt of the order in the court below shall be released on interim bail for four months on furnishing bail bonds of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bagaha, District- West Champaran, in connection with Bagaha
Patna High Court Cr.Misc. No.41376 of 2014 (2) dt.23-04-2015 Mahila P.S. Case No. 12 of 2014 subject to condition as laid down under Section 438 (2) of Cr.P.C. Further condition that after one month of release of the petitioner, he will take the victim and keep her with due dignity or pay maintenance Rs. 1200/- per month till any maintenance is decided by the competent court and trial court on being satisfied that petitioner shall either keep the victim with due dignity and honour or pay maintenance Rs. 1200/- per month to the victim shall confirm the bail bond of the petitioner. With the above observation, the petition is disposed of. m.p.
