Learned counsel appearing on behalf of petitioner submits that the grievance of the petitioner in the present writ application is non consideration of the case of the petitioner for grant of gun license. The gun license was originally issued in favour of the father of petitioner. Learned counsel for the petitioner further submits that the father of the petitioner has crossed 70 years and as such petitioner being son of the original licensee namely Virat Anand had applied for consideration of his case for grant of gun license in place of his father. Learned counsel for the petitioner submits that the

Patna High Court CWJC No.7113 of 2019(2) dt.09-04-2019 2/2 contrary to the rule with regard to grant of gun license at the earliest, the matter of petitioner is still pending at the level of District Magistrate since 26.03.2018.

Considering the fact that the petitioner has approached the District Magistrate for consideration of grant of gun license in place of his father, the respondents have to take appropriate decision at the earliest.

In the totality of the facts situation, it would be appropriate that the respondents may take final decision one way or the other in the light of their own decision and also on consideration of judgment of the Division Bench reported in State of Bihar and Ors. Vs. Deepak Kumar (LPA No. 758 of 2018) reported in 2019(1) PLJR 664 which is settler on the point of grant of gun license.

With the aforesaid, the present application stands disposed of with direction to the District Magistrate, Patna to take appropriate decision on the application of the petitioner for grant of gun license within a maximum period of 90 days from the date of receipt of the copy of this order.
