The petitioner apprehends his arrest in connection with Bachhawara P.S. Case No. 22 of 2013 registered under Sections 406 and 120(B)/23 of the Indian Penal Code pending in the Court of C.J.M., Begusarai.
The allegation is that petitioner was driver of the J.C.B. of the informant at his brick kiln. The petitioner took the motorcycle of the informant for domestic work but did not return it to the informant.
Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case due to dispute of arrear of salary. It is also submitted that petitioner used to work as a driver of J.C.B. at the brick kiln of the
Patna High Court Cr.Misc. No.47558 of 2014 (2) dt.23-04-2015 2/2 informant. He handed over his old motorcycle to the petitioner with commitment that when his arrear of salary is paid, he will return his motorcycle, but due to ulterior motive, the informant has falsely implicated the petitioner in this case. In course of investigation, the Police also recovered the motorcycle from the house of the petitioner.
Having considered the facts and circumstances of the case, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, the application stands rejected. However, petitioner is directed to surrender before the trial Court within a period of four weeks and pray for regular bail, which shall be considered on its own merit without being prejudiced by the present order.
