2. Petitioner seeks regular bail in connection with Charpokhari P.S. Case No. 83 of 2015 in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, informant received information that one Mantu Paswan sustained gunshot injury. On hulla, he along with his sons went at the door of his house. At that time, all the FIR named accused persons armed with fire-arms and pistol reached there and fired, due to which son of informant namely, Chandan Yadav sustained gunshot injury and during the course of treatment, he died.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.26595 of 2025(2) dt.27-06-2025 2/2 petitioner is not named in the FIR and name of petitioner transpired during the course of investigation. One co-accused namely, Akhilesh Sah @ Pauva, who was named in the FIR, has been granted bail by this Court vide order dated 18.10.2024 passed in Cr. Misc. No. 50060 of 2024. Petitioner is in custody since 19.10.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions JudgeXI, Bhojpur, in connection with Charpokhari P.S. Case No. 83 of 2015.
