JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 498(A), 304(B)/34 of the Indian Penal Code.
Petitioner happens to be husband of the deceased and according to prosecution case, deceased died within three years of her marriage in other than normal circumstances. There is allegation of illegal demand and torturing.
Regard being had to the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and
Patna High Court Cr.Misc. No.45446 of 2016 (3) dt.01-12-2016 2/2 hence, his prayer for bail in connection with Sessions Trial No. 694 of 2016 arising out of Harsidhi P.S. Case No. 461 of 2015 pending in the court of 8th Additional Sessions Judge, Motihari, East Champaran stands rejected.
However, petitioner may renew his prayer for bail after six months, if his trial is not concluded within the above stated period.
