The petitioner is accused in connection with Sadar P.S. Case No. 133 of 2018 registered under sections 304(B) and 302/34 of the I.P.C. pending in the Court of District and Sessions Judge, Darbhanga.

Submission of learned counsel for the petitioner is that petitioner is innocent and has committed no offence as alleged in the F.I.R. Further submission is that petitioner has been made accused in this case due to land dispute and is in custody since 20.04.2018.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with

Patna High Court Cr.Misc. No.78573 of 2018(2) dt.25-01-2019 2/2 submission that the daughter of the informant was tortured physically and mentally by the petitioner and other accused persons for demand of dowry and in the several paragraphs of the case diary, witnesses have also supported the prosecution version.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
