The petitioner seeks bail in connection with Khusrupur P.S. Case No. 144 of 2019 for the offence under Sections 302/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, the alleged occurrence took place on 18.05.2019 at 1:00 AM in whereas the F.I.R. has been lodged on 19.05.2019 at 3 P.M. after much delay which creates doubt over the prosecution version. These petitioners were not involved in the alleged

Patna High Court CR. MISC. No.24996 of 2020(2) dt.10-11-2020 2/2 offence and have falsely been implicated in this case. The petitioners are rotting in custody since 06.01.2020. Considering the facts and circumstances of the case, let the, above named, petitioners be released on bail on furnishing their personal bond to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City, in connection with Khushrupur P.S. Case No. 144 of 2019.
