The petitioner is apprehending his arrest for the offences instituted under Sections 498(A) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The prosecution story, in brief, is that complaint was married to the petitioner. After one year of marriage, the petitioner along with others started demanding rupees fifty thousand, a color T.V. and a motorcycle. They used to torture the complainant and tried to burn her by pouring kerosene oil, but she was saved by nearby people. The complainant also has illicit relationship with one Punam Singh. A Panchayati was conveyed in which the petitioner has assured that he will not demand or torture her in future, but on 30.12.2011, the accused persons assaulted her and

Patna High Court Cr.Misc. No.46279 of 2014 (3) dt.03-09-2015 P2/2 after snatching her ornaments and cloths ousted her from the house.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that father of the complainant had instituted a case vide Annexure -2 stating that his daughter has eloped Sintu Rawat and a similar complaint was also filed by this petitioner which is Annexure-3 to the present application.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R. and is the husband of the complainant.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Complaint Case No. 132c/2012 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jamui, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
