Petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354 of the Indian Penal Code.

It is alleged that when the complainant was going to answer call of nature then this petitioner tried to outrage the modesty of the complainant but the alarm being raised by the complainant, the petitioner fled away. It is further alleged that when family members of the complainant made protest then they were assaulted and gold ornaments were snatched.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.46766 of 2014 (2) dt.23-04-2015 2/2 petitioner that initially the accusation appears to be very unreasonable. In fact, the petitioner filed Ara Town P.S. Case No. 248 of 2013 against the husband and family members of the complainant at earlier point of time, hence as a retaliatory measure the present complaint has been filed. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Complaint Case No. 2215(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
